Three members (James Davis, George Evans and John Owens) were listed as absent. Note: Robert Molesworth was Solicitor-General 28 November 1855 to 17 June 1856, but resigned on being appointed a judge and was not a candidate at this election. William C Haines formed the first Victorian ministry on 28 November 1855. Although there were no firm party loyalties at this time it was essentially a conservative ministry. "The Age" called it "an oligarchical clique." Haines was defeated on a confidence vote on 2 March 1857 and succeeded by a more liberal ministry under John O'Shanassy. That ministry was unable to command a stable majority and resigned after a defeat on 23 April. Haines returned to office, but was again defeated, on the principle of equal enrolments in electorates, on 23 February 1858. O'Shanassy formed a new ministry, which remained in office until the election in August-September 1859.
